ActivePure SMS Program Terms & Conditions

These Terms and Conditions ("Terms") govern participation in the ActivePure SMS Messaging Program (the "Program") operated by ActivePure ("ActivePure," "we," "us," or "our").
By enrolling in the Program, you agree to these Terms and our Privacy Policy.
1. Program description
The Program provides business-related SMS and MMS communications to representatives of organizations that have a business relationship with ActivePure or have requested information about ActivePure products and services.
Messages may include:
- Account notifications
- Product information
- Training and educational content
- Event invitations and reminders
- Customer support communications
- Service updates
- Business-related announcements
2. Consent to receive messages
By providing your mobile number and submitting the enrollment form, you expressly consent to receive recurring automated and non-automated text messages from ActivePure.
Consent is not a condition of purchase.
Message frequency varies.
Message and data rates may apply.
3. Eligibility
You represent that:
- You are at least 18 years old.
- You are authorized to provide the mobile number submitted.
- You are the account holder or have permission from the account holder to enroll the number.
- You are located within the United States.
4. Message frequency
Message frequency will vary depending on your relationship with ActivePure, account activity, requested communications, and events.
5. Costs
Message and data rates may apply according to your wireless service plan.
You are solely responsible for any charges imposed by your wireless carrier.
6. Opt-out instructions
You may cancel participation at any time by replying STOP.
Upon receipt of your STOP request, you will receive a final confirmation message and no further messages will be sent unless you opt in again.

8. Carrier disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
Message delivery is subject to effective transmission by your wireless carrier and network availability.
9. Privacy
Information collected through the Program is governed by our Privacy Policy.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Text messaging originator opt-in data and consent information will not be shared with any third parties except service providers supporting Program delivery.
10. Program changes
We reserve the right to modify, suspend, or terminate the Program at any time.
We may revise these Terms periodically. Continued participation following publication of revised Terms constitutes acceptance of the updated Terms.
11. Disclaimer of warranties
The Program is provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied.
12. Limitation of liability
To the fullest extent permitted by law, ActivePure shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from participation in the Program.
13. Governing law
These Terms shall be governed by and construed in accordance with the laws of the state in which ActivePure maintains its principal place of business, without regard to conflict of law principles.
